Terms of Use

These draft Terms of Use are intended to explain the basic rules for using FSSYNC. They should be reviewed by legal counsel before being relied on as final legal terms.

1. Acceptance of Terms

By accessing or using FSSYNC, you agree to these Terms of Use. If you use FSSYNC on behalf of a company or organization, you represent that you have authority to use the service for that organization and to follow these terms.

2. Description of Service

FSSYNC is a software platform for food safety recordkeeping, inspections, logs, corrective actions, evidence, review workflows, PDF reports, archives, and related operational documentation.

3. No Compliance Guarantee

FSSYNC helps organize and manage food safety records, but it does not guarantee regulatory compliance, certification, FDA approval, USDA approval, GFSI certification, or any legal or regulatory approval.

FSSYNC does not replace professional judgment, legal advice, food safety consulting, regulatory requirements, or customer responsibility. Customers remain responsible for their own food safety programs, records, decisions, validation, verification, and compliance obligations.

4. User Accounts and Access

Users must provide accurate account information and are responsible for protecting their account credentials. Users must not share passwords or attempt to access records, facilities, reports, or company data they are not authorized to access.

Company administrators are responsible for assigning appropriate roles, facilities, permissions, and access for their teams.

5. Customer Data

Customers retain ownership of the records, templates, logs, inspection answers, corrective actions, evidence, media, and other content they enter or upload into FSSYNC.

Customers are responsible for the accuracy, completeness, and lawful use of their records and user-entered content. FSSYNC may process customer data to provide, secure, support, and improve the service.

6. Acceptable Use

Users may not use FSSYNC unlawfully, attempt unauthorized access, upload malicious content, interfere with service operation, misrepresent records, falsify records, or access facilities, reports, or company data they are not authorized to access.

7. Files, Photos, Videos, and Evidence

Users are responsible for uploaded evidence, including photos, videos, and files. Evidence should be relevant, authorized, lawful, and intended to support food safety or operational records.

8. Availability and Changes

FSSYNC may change, improve, suspend, or discontinue features. Early pilot and founding customer features may change as the platform develops. FSSYNC does not guarantee uninterrupted or error-free service.

9. Fees and Payment

Subscription pricing and billing terms are confirmed during onboarding or in a written agreement with FSSYNC. Continued access to paid features may depend on payment status and the applicable agreement.

To cancel a FSSYNC subscription, contact support@fscfy.net. Cancellations are processed manually and are typically scheduled for the end of the current billing period. Customer records are not automatically deleted when a subscription is canceled.

10. Confidentiality and Security

FSSYNC uses reasonable safeguards designed to protect customer information. Users must also protect credentials and access. No software system or transmission method can be guaranteed to be 100% secure.

11. Limitation of Liability

To the maximum extent permitted by law, FSSYNC and its owners, operators, employees, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, business interruption, compliance failures, audit findings, regulatory actions, or similar losses arising from use of the service.

12. Termination

Accounts or access may be suspended or terminated for misuse, nonpayment, unauthorized access, violation of these terms, or the end of a subscription, pilot, or customer relationship.

13. Governing Law

Unless otherwise required by law, these Terms are governed by the laws of New York, without regard to conflict of law principles.
